Civil Process:
Civil process is the action taken to begin the court process. In Michigan, “Civil process in the district court shall be served by a sheriff, deputy sheriff or a court officer appointed by the judges of the court for that purpose” (MCL 600.8321). This includes personally serving court documents such as small claims, summons and complaint, writs of garnishment, personal protection orders (PPOs), subpoenas for court appearances and orders to seize goods subject to claim. Additionally, the Sheriff conducts mortgage foreclosure sales and executes orders of eviction in landlord/tenant cases. In 2023 the Sheriff’s Office served 291 papers, held 7 foreclosure sales, and conducted 5 evictions.
